When you make a booking you agree to the rental conditions below. So please take a look at them when you want to book.
The general terms and conditions apply to the home made available on the website www.pouget.be at the expense of the owner. They are an essential element of the posting contract; consequently, these conditions can only be deviated from if the owner has agreed to them in advance and in writing.
The tenant can therefore under no circumstances claim the application of his own general terms and conditions, whatever these may be. If the customer wishes to deviate from Pouget's general terms and conditions, he must expressly request this in advance at the time of booking. In this case, these general terms and conditions nevertheless continue to apply in an additional manner.
Terms and Conditions

Rental period:
The relevant contract has been concluded for the aforementioned period. The tenant is not entitled to the property outside this period.

The booking:
The booking and agreement is concluded between the landlord (= owner of the holiday home) and the tenant. The landlord cannot be held liable for the damage suffered by the tenant during his stay and the tenant waives any rights against the landlord by signing the contract,

Price:
The published prices are the prices per week, from Saturday to Saturday, per holiday home. The prices apply as stated on the website, unless explicit mention of a price discount on the contract. Additional services such as final cleaning and the supply of bed linen are included in the price.

Deposit:
When booking, you pay an advance of 30% of the rental price within 7 days. You pay the balance 8 weeks before departure. When booking less than 8 weeks before departure, the full amount must be paid.

State of the property:
The holiday home is checked every time. If things should deviate from the description or if there should be damage, you must immediately report this to the owner on site, also to avoid this being attributed to you! The problem will then be resolved as soon as possible. Complaints that are not reported during the stay will no longer be accepted afterwards. You must leave the relevant property on departure in the same condition as you found it on arrival. All loss due to breakage or damage to the home or contents must be reimbursed by the tenant. For the included final cleaning, we assume that the house is left in a correct state. Ie dishes done, garbage gone, no leftovers, barbecue clean. In case of non-compliance with these conditions, additional cleaning costs may be charged at 25 euros/hour.

Sorting household waste
The glass waste/cans and drink cartons must be brought to the glass container by the tenant himself. Attention! If the cleaning service has to sort the household waste or take the glass to the glass container, extra cleaning hours will be charged or the tenant will be fined 20 to 50 euros. Sorry, this measure is unfortunately necessary to encourage sorting.

Guarantee:
The holiday homes have valuables and the deposit serves to compensate for any accidents or damage.

Complaints related to inventory and existing damage are accepted up to 4 hours after your arrival. This must be reported to the owner on site.

The inspection of the holiday home is done during the cleaning because only then everything has been thoroughly checked. It is therefore during brushing that damage or breakage can be detected. It may happen that the holiday home is in such a state that extra cleaning hours have to be charged. ATTENTION! the house must be broom clean and tidy, garbage sorted and bins emptied.

When everything has been left in good order and no damage or breakage has been found, your deposit will be returned one to two weeks (stated in the booking email) after your stay via bank transfer. If damage exceeds the amount of the deposit, the tenant is obliged to make an additional payment.

It is good to report accidents to the owner, these are usually handled properly.

The owners do not abuse the deposit. But one can become very critical when one finds that there was no respect for the home and/or one has concealed accidents.

If you break something, it is advisable to keep the broken pieces aside for the inventory. This way the owner can determine which broken piece it is about and this prevents discussions and misunderstandings.

In the event of an accident or dispute, it is advisable to communicate with the owner, so that things can be clarified and a solution can be reached that both parties can accept.

The deposit is only refunded after two weeks, only to resolve the above cases first.

Fortunately, almost all guests are honest.

Time of departure and arrival:

Please respect the arrival and departure times. We, like you probably, like to arrive and stay in a neat holiday home. Therefore, there must be sufficient time for a good cleaning between the departure of the previous guests and the arrival of the new guests.

Arrival time: the holiday home is at your disposal from 15:00 on the day of arrival. This is clearly stated at the holiday home.

Departure time: Before 10 am

Number of persons allowed:
The number of people occupying the property may not exceed that stated in the contract, without the prior consent of the owner. The number of persons with name and age is stated on the contract. If upon arrival on site it appears that there are more persons than stated on the contract, the owner has the right to request an additional cost (€ 50/pp/night for rental price < € 1000/week and € 80 pp/night for rental price > € 1000 /week) or to refuse the excess of persons or, if exceeded, consider the rental agreement as legally dissolved and access to the holiday home will be refused without entitlement to a refund of the rent. It is also prohibited to place tents, mobile homes or caravans without the express permission of the owner). Babies regardless of age are also included. If the maximum number of persons is exceeded, the regulations regarding fire safety and fire insurance are no longer in accordance with the regulations.
You may receive guests, after consultation with the owner, it is determined in advance when and how many people will be present.

Pets
Pets are not allowed in the holiday home and on the domain.

Energy costs (water, gas and electricity):
These are almost everywhere included in the rental price; the few exceptions are specifically stated on the rental agreement. Heating costs during the off-season period must be reimbursed separately. If lighting is left on unnecessarily in the event of absence, additional costs may follow.

Accidents:
The owner of the house is not responsible for any accidents in and around the house or the swimming pool.

Liability of the tenant

We kindly ask you to respect the house and the garden.

The rented holiday home must be occupied by the tenant, his co-tenants or his visitors with the required care and care, with due regard for the tranquility of the environment.

The main tenant is liable for damage caused by him/her, by co-tenants, by any visitors, even if these are discovered after his departure. If damage is found after the departure of the main tenant, he will have to comply with the owner's decision.

House rules present and/or provided with the holiday home are an integral part of the rental agreement and must therefore be strictly observed.

The tenant must ensure that he does not cause noise nuisance to local residents and other guests. There is a law in France that prohibits outdoor noise after 10pm. Anyone who thinks that this does not apply to him/her will be removed from the holiday home without prior warning - without return of rent.

Please DO NOT MOVE FURNITURE such as BEDS, COUCHES, CABINETS - PLEASE MOVE. Even if you think you are so careful, these things often lead to damage to walls and furniture, please leave them in place.

It is not allowed to burn wood in the barbecue or to make a fire in the garden

It is prohibited to use the holiday homes to organize parties and/or drinks, in order to guarantee the quality of the home.

Smoking: It is totally forbidden to smoke in the holiday homes, if smoke smell is detected during cleaning, additional costs may follow (washing curtains or mattresses).

Owner's liability

The owner cannot accept liability for loss, theft, damage or injury of any kind caused to tenants, their children's games or gardens.

The (price) information stated on the website is leading.

The owner cannot accept liability for damage caused by natural disasters, natural disasters, nuclear disasters, attacks, strikes, acts of violence and coming into contact with an aircraft or parts thereof.

It may happen that 'work' takes place in the vicinity of your holiday home. We think, for example, of breaking up the road, construction activities or power cuts. You will understand that we cannot accept any responsibility for any noise or nuisance. After all, we cannot stop such activities.

French law applies to all booking agreements and subsequent agreements.

The lease is between the tenant and the owner.

Cancellation conditions:
In the event of cancellation by the tenant who has not taken out cancellation insurance or who falls outside the terms of the insurance, the tenant is
• the deposit paid (40% of the total sum) is due up to 8 weeks before departure.
• from 8 weeks before departure the total rental price is due.
You are not entitled to a refund in the event of early departure or not using the house.

Cancellation by owner of gîte Pouget
If any circumstance forces the owner of gîte Pouget to cancel the already rented holiday home, the tenant will be notified immediately and, if possible, an alternative will be offered. If this alternative is not accepted by the tenant, or if the owner of gîte Pouget is unable to offer an alternative, he will immediately refund the amount already paid by the tenant. The tenant has no more or other right than to reclaim this amount.

Insurance: Cancellation insurance:
We recommend that you take out cancellation insurance with your insurer.
The cancellation insurance does not cover civil liability, any damage caused by you or liability in the event of fire or theft if you are at fault or due to your negligence. Please consult your insurance company yourself to check whether you have suitable damage cover for this. You as the tenant are responsible for damage that is not covered by your insurance.The owner cannot be held liable for damage suffered by the tenant or third parties as a result of staying in the holiday home.
